A Prenuptial Agreement is an Agreement which is drawn up between the future spouses before the marriage.
It will set out the arrangements in the event of the breakdown of the marriage at a later date.
Prenuptial Agreements are not binding upon the Courts.
They can be persuasive however providing that:
- They are entered into at least six weeks prior to the marriage.
- They are fair.
- Both parties disclose honestly their true financial circumstances to the other before the Agreement is entered into.
- Both parties obtain their own independent legal advice before entering into the Agreement.
- There are no substantive changes to the parties’ circumstances subsequent to the signing of the Agreement.
They are becoming more and more popular because people want to have some certainty in the event that the worst happens.
