Generally speaking, the Courts encourage the parents to try and work out the arrangements for the children themselves. If that is not possible, either one of them can apply to the Court for assistance in this regard.

The Court, when making Orders in respect of the children, will take into account what is in the children’s best interests before making a final decision. That may mean that the children are shared between the parents or that the children spend most of their time with one of the parents and not so much time with the other. Alternatively, it may mean that one parent sees little, if any, of the children, depending upon the circumstances.

Again, the test for the Court is what is in the best interests of the children.
